About the company

OVAK Ltd has been importing Marlenka cakes to the UK since 2005 after discovering this culinary delight during a holiday to the Czech Republic. As appointed distributor for the UK, we are proud to supply these cakes to up-market restaurants in the Thames Valley, traditional tea rooms in Bath and a number of wholesale customers in London.

Orders

  1. Orders placed with OVAK Ltd (thereafter Vendor) have to be presented in writing, clearly stating the product name and type, quantity, Buyer’s contact details, delivery details, for example Buyer’s hours of business or other issues related to unloading at Buyer’s premises.
  2. An order placed with Vendor can be cancelled by email or other means in writing within 24 hours from order placement; after that it becomes binding for both the Buyer and Vendor.
  3. The Vendor will confirm order in writing after the 24-hour period. The order will then become binding for the Vendor unless previously cancelled.
  4. Delivery will generally take up to two weeks from the time of placing the order with the Vendor. The Buyer has to allow a sufficient time for the two-week delivery time necessary for wholesale ordering.
  5. The Vendor reserves the right to extend the two-week delivery period or cancel the order in exceptional circumstances. These may be but are not limited to: manufacturer’s error, logistical difficulties, political unrest or natural disasters. In such cases the Vendor will advise the Buyer in writing as soon as such circumstances arise.
  6. The process of ordering is complete once the shipment is unloaded at the Buyer’s premises or the address nominated by the Buyer.

Prices

  1. Price list on application.
  2. Price includes transport from the Czech Republic to the UK.

Payments

Proforma in GBP on the three first orders, thereafter 30-day account pending bank and other business references.

Title to the goods

Ownership of the goods only passes to the Buyer upon full payment of the relevant invoice.

Use-by date

The Vendor undertakes to ensure that the use-by date on products is not disproportionately reduced by the factory expedition procedures and transport from the Czech Republic to the UK. In general the reduction should not exceed 12 per cent of the use-by date stated by the product description.

Damaged goods

  1. The Buyer will notify the Vendor in writing immediately after delivery about any damage or any other shortcomings and will supply photo documentation of the damage if possible. In order to claim compensation, the Buyer will be required to submit the stamped and correctly dated delivery note issued by the haulier on unloading.
  2. The Vendor will not refund or replace the products if the Buyer fails to produce the delivery note.
  3. Furthermore, no refund or replacement will be issued in the following circumstances:
    • Damage to the goods caused by the Buyer’s handling
    • Failure by the Buyer to take proper care of the goods
    • Goods damaged by the elements whilst in Buyer’s possession.
